Your privacy matters to Telso Technologies and Services Private Limited (the “Company”, “We”, “Telso”, “Our” “our” or “Us” or “us”).  

This Privacy Policy explains how We collect, process, use, share and protect  information about you. It also tells you how you can access and update your  information and make certain choices about how your information is used.  

The Privacy Policy covers both “online” (e.g., web and mobile services, including any  websites operated by us such as https://www.telsotech.in or Mobile Application  (“Waipham Sanpham”), however accessed and/or used, whether via Protected  computers, mobile devices or otherwise) and “offline” (e.g., collection of data through  mailings, telephone, or in person) activities owned, operated, provided, or made  available by the Company.  

Our “online” and “offline” activities, in relation to facilitation of Commodity renting  services, are collectively referenced as the “Platform” or the Services”.  

This Privacy Policy also applies to your use of interactive features or downloads that:  i) we own or control;  

ii) are available through the Company’s Services; or  

iii) interact with the Services and post or incorporate this Privacy Policy.  

BY ACCEPTING THE TERMS AND CONDITIONS, YOU AGREE TO THE TERMS  OF THIS PRIVACY POLICY. Please review the following carefully so that you  understand our privacy practices. If you do not agree to this Privacy Policy, do not  accept the Terms and Conditions or use our Services. This Privacy Policy is  incorporated by reference into the Terms and Conditions.

The Meaning to the Capitalized terms used in the Privacy Policy are derived from the  terms defined in the Terms and Conditions unless specified hereunder.  

INFORMATION WE COLLECT:  

Protected Information: We may ask you to provide certain Protected Information to  us. We may collect this information through various means and in various places for  the provision of Services, including account registration forms, contact us forms, or  when you otherwise interact with us. When you sign up to use the Services, you create  a user profile. We shall ask you to provide only such Protected Information which is

for lawful purpose connected with our Services and necessary to be collected by us  for such purpose.  

The Information you provide to us includes the following:  

Your account information: Your full name, email address, postal code, password  and other information you may provide with your account, such as your gender, mobile  phone number and website. Your profile picture that will be publicly displayed as part  of your account profile. You may optionally provide us with this information through  third-party sign-in services such as YouTube, Instagram, Facebook, Google etc. In  such cases, we fetch and store whatever information is made available to us by you  through the Registration Data.  

Your preferences: Your preferences and settings such as time zone and language.  

Your content: Information you provide through our Platform or the Services, including  your profile, reviews, media, comments, updates, ordering details and history, and  other information you provide on our Platform or the Services.  

Your searches and other activities: The search terms you have looked up and  results you selected.  

Your browsing information: How long you used our Platform or the Services and  which features you used; the ads you clicked on.  

Your communications: Communications between you and other users, Proprietors  through our Platform or the Services; your participation in a survey, poll, contest or  promotion scheme; your request for certain features (e.g., newsletters, updates or  other products); your communication with us about employment opportunities posted  to the Platform or the Services.  

Your transactional information: If you make a transaction through our Platform or  the Services, we may collect and store information about you to process your requests  and automatically complete forms for future transactions, including (but not limited to)  your phone number, address, email, billing information and credit or payment card  information. This information may be shared with third-parties which assist in  processing and fulfilling your requests, including PCI compliant payment gateway  processors.  

Your Posts: You also may provide information (such as media, ratings, reviews,  comments, likes, bookmarks, etc.) to be published or displayed (hereinafter, “posted”)  on publicly accessible areas of our Platform or the Services, or transmitted to other  users of our Services or third-parties (collectively, “User Contributions”). Your User

Contributions are posted on and transmitted to others at your own risk. Additionally,  we cannot control the actions of other users of our Services with whom you may  choose to share your User Contributions. Therefore, we cannot and do not guarantee  that your User Contributions will not be viewed by unauthorized persons. We display  this information on the Platform or the Services, share it with businesses, and further  distribute it to a wider audience through Platform or the Services. You should be  careful about revealing any sensitive details about yourself in such postings.  

Information you choose to share from your social networks: We may collect,  process and store your user ID associated with any social media account (e.g.  YouTube, Instagram, Facebook, Twitter, or Google) that you use to sign into the  Platform or the Services or connect with or use with the Platform or the Services. When  you sign in to your account with your social media account information, or otherwise  connect to your social media account with the Platform or the Services, you consent  to our collection, storage, and use, in accordance with this Privacy Policy, of the  information that you make available to us through the social media interface. This  could include, without limitation, any information that you have made public through  your social media account, information that the social media service shares with us  including your contact list, or information that is disclosed during the sign-in process.  For further information, as to how and for what purpose the social network provider  processes your data, please see the relevant privacy policies of these social network  providers.  

Information We Collect Through Automatic Data Collection Technologies: We  may automatically collect certain information about the computer or devices (including  mobile devices) you use to access the Platform or the Services, and about your use  of the Platform or the Services.  

Usage information: Details of your use of our Platform or the Services, including  traffic data, location data, logs and other communication data and the resources that  you access and use on or through our Platform or the Services.  

Computer and device information: Information about your computer, Internet  connection and mobile device, including your IP address, operating systems,  platforms, browser type, other browsing information (connection, speed, connection  type etc.), device type, device’s unique device identifier, mobile network information  and the device’s telephone number.  

Stored information and files: Our applications also may access metadata and other  information associated with other files stored on your mobile device. This may include,  for example, photographs, audio and video clips, Protected contacts and address book  information.

Location information: Our applications collect real-time information about the  location of your device, as permitted by you.  

Last URL visited: The URL of the last web page you visited before visiting our  websites.  

Mobile device IDs: Unique mobile device identifier, if you’re using our Platform or the  Services on a mobile device, we may use mobile device IDs (the unique identifier  assigned to a device by the manufacturer), instead of cookies, to recognize you. We  may do this to store your preferences and track your use of our applications. Unlike  cookies, mobile device IDs cannot be deleted. Advertising companies may use device  IDs to track your use of our applications, track the number of advertisements  displayed, measure advertising performance and display advertisements that are  more relevant to you. Analytics companies may use mobile device IDs to track your  usage of our applications.  

Your preferences: Your preferences and settings such as time zone and language.  

Your activity on the Platform or the Services: Information about your activity on the  Platform or the Services, such as your search queries, comments, search results  selected, number of clicks, pages viewed and the order of those pages, how long you  visited our Services, the date and time you used the Platform or the Services, error  logs, and other similar information.  

Mobile status: For mobile application users, the online or offline status of your  application.  

Other information: If you use our website, we may collect information about your  device, IP address and the browser you're using. We might look at what website you  came from, duration of time spent on our website, pages accessed or what website  you visit when you leave us. We might also collect what type of mobile device you are  using, or the version of the operating system your computer or device is running.  

Cookies: Information may be collected using a cookie. If you do not want information  to be collected through the use of cookies, your browser / app settings allows you to  deny or accept the use of cookies. Cookies can be disabled or controlled by setting a  preference within your web browser or on your Device. If you choose to disable  cookies or flash cookies on your Device, some features of the Platform or the Services  may not function properly or we may not be able to customize the delivery of  information to you. The Company cannot control the use of cookies (or the resulting  information) by third parties, and use of third-party cookies is not covered by our Policy.  

PERMISSIBLE AGE:

The Platform or the Services are not intended for users under the age of 18, unless  permitted under applicable local laws (“Permissible Age”). We do not knowingly collect  any Protected Information from users or market to or solicit information from anyone  under the Permissible Age. If we become aware that a person submitting Protected  Information is under the Permissible Age, we will delete the account and any related  information or data as soon as possible. INFORMATION THIRD PARTIES PROVIDE ABOUT YOU:  

We may, from time to time, collect Information about you through the Platform or while  availing the Services and collect Information from our affiliates or third parties such as  technical sub-contractors, business partners, analytics providers, search information  providers, payment service providers, etc., and also from publicly available sources  such as commercially available marketing lists, social networks and other related  media.  

USE OF INFORMATION COLLECTED:  

We use the information you provide to us to enhance the functionality and improve the  quality of our Platform or the Services, and to Protect your rights and enhance your  experience while using the Platform or the Services. We also use this information to  display relevant advertising, provide support to you, communicate with you, and  comply with our legal obligations. We may use your Information we collect in  accordance with this Privacy Policy for the following purposes:  

1. To enable you to access the Platform; 

2. To verify your identity and/ or your capacity, under applicable law, to provide  Services through the Platform; 

3. To contact you for confirmation of the order request on our website or for other  promotional purposes.  

4. To closely monitor which features of the Services are used most, to allow you to  view your order history, orders, and to determine which features need to be  improved for enhanced user experience, including usage patterns and geographic  locations to determine where we should offer or focus services, features and/or  resources; 

5. To send you a welcome email/SMS to verify your username and password;

6. To provide you the correct app version depending on your Device type, for  troubleshooting and in some cases, marketing purposes; 

7. To help diagnose problems with our computer server, and to administer Platform; 

8. To send you strictly service-related announcements on rare occasions when it is  necessary to do so. For instance, if our Services are temporarily suspended for  maintenance, we might send you an email. If you do not wish to receive them, you  have the option to deactivate your account; 

9. To prevent, discover and investigate violations of this Policy or any applicable terms  of service or terms and conditions; 

10. To identify and/or detect security breaches or attacks, errors, fraud, money  laundering, abuse and other criminal activities, and investigating and taking  appropriate remedial action; 

11. We provide some of your Protected Information (such as your name, pick up  address, contact number) to the Delivery Partner who accepts your request for  Services so that the Delivery Partner may contact and find you; 

12. If you are a Proprietor, we use geo-location information for various purposes,  including for you to be able to view the Delivery Partners in your area that are close  to your location to provide services to you, to automatically fetch your location when  you open the Platform, for the Delivery Partner to identify the pickup location and to  allow you (if you choose through any features we may provide) to share this  information with other people for your safety; 

13. If you are a Delivery Partner, we use the geo-location information for (only when the  Delivery Partner activates the icon “On-Duty” on the Platform) you to receive orders  close to your location even when the Platform is not in use or closed, to enable the  User to track the distance of the Delivery Partner from their location for pick up, to  share the exact location for the safety of the User, etc.; 

14. If you are a Delivery Partner, we may share your name, number, e-mail, phone  number and/or profile picture (if applicable), tracking details with our Users to  provide them the Services; 

15. We may use your Information that we collect about you:  

i) to provide you with information or services or process transactions that you  have requested or agreed to receive including to send you electronic  newsletters, or to provide you with special offers or promotional materials on  behalf of us or third parties;

ii) to enable you to participate in a variety of the Services’ features such as online  or mobile entry sweepstakes, contests or other promotions;  

iii) to contact you with regard to your use of the Services and, in our discretion,  changes to the Services and/or the Services’ policies;  

iv) for internal business purposes;  

v) for inclusion in our data analytics; and  

vi) for purposes disclosed at the time you provide your Information or as  otherwise set forth in this Policy; 

16. To enhance your user experience in relation to the Platform or the Services,  including customisation / Protection of the Platform or the Services; 

17. To provide relevant offers or rewards to you, based on your consumption patterns; 18. To enforce our terms and conditions and this Policy, and resolve any disputes; 

19. To provide functionality, analyse performance, fix errors, bugs, and improve the  usability and effectiveness of the Platform; 

20. To comply with Applicable Laws or requests received from regulators, government,  law enforcement or judicial authorities under Applicable Laws or our contract with a  third party; 

21. To carry out our obligations and enforcing rights arising from any contracts between  us; 

22. To disclose to affiliates, our and their employees, agents and representatives on a  need-to-know basis to facilitate provision of Services; 

23. To deliver any administrative notices, alerts, advice, notifications and  communication relevant to your use of the Services, through social media (including  WhatsApp), SMS and other media; 

24. To answer your queries concerning our products or services or to respond to your  requests or questions 

25. To fulfil any other purpose for which you provide us the Information and/or for any  other purpose with your consent.  

Please note, We do not use the information collected from you for targeted  advertising.

We may disclose Protected information that we collect or you provide, as described in  this Privacy Policy, in the following ways:  

i) to Affiliates, which are entities under common ownership or control of our  ultimate parent Company Telso Technologies and Services Private Limited.  ii) to contractors, service providers and other third-parties whom we use to support  our business (e.g. Proprietors on the platform) and who are bound by  contractual obligations to keep Protected information confidential and use it  only for the purposes for which we disclose it to them.  

iii) to a buyer or other successor in the event of a merger, divestiture, restructuring,  reorganization, dissolution or other sale or transfer of some or all of the  Company’s assets, whether as a going concern or as part of bankruptcy,  liquidation or similar proceeding, in which Protected information held by the  Company about the users of our Services are among the assets transferred.  

iv) to third-parties to market their products or services to you if you have consented  to receive the promotional updates. We contractually require these third-parties  to keep Protected information confidential and use it only for the purposes for  which we disclose it to them.  

v) to fulfil the purpose for which you provide it.  

vi) for any other purpose as disclosed by us from time to time when you provide  the Protected information.  

WHEN YOU AGREE TO SHARE INFORMATION WITH THIRD PARTIES:  

You may opt to receive information and/or marketing offers directly from third parties  when you access third party links on the Platform. If you do agree to have your  Protected Information shared, your Protected Information will be disclosed to such  third parties and all Information you disclose will be subject to the Privacy Policy and  Data practices of such third parties. We are not responsible for the Privacy Policies  and Data practices of such third parties and, therefore, you should review the privacy  Policies and Data Practices of such third parties prior to agreeing to receive such  information from them. If you later decide that you no longer want to receive  communication from a third party, you will need to contact that third party directly  according to their terms of use or Privacy Policy.  

SHARING OF INFORMATION WITH THIRD-PARTIES:  

1. We will share information with third parties who perform services on our  behalf: We may share information with vendors who help us manage our delivery  process or payment processors or transactional message processors.

2. We may share information if we think we have to in order to comply with the  law or to protect ourselves: We will share information to respond to a court order  or judicial summons. We may also share it if a government agency or investigatory  body requests. Or, we might also share information when we are investigating  potential fraud.  

3. We may share information with any successor to all or part of our  business: For example, if part of our business is sold we may give our customer  list as part of that transaction.  

4. We may share information for market study and other benefits: We may  share your information, including your Protected Information and Usage Information  with third parties for any purpose, including but not limited to undertaking market  research/ study, conduct data analysis, determine and customize product or service  offerings, to improve the products or Services or to make any other  benefits/products/ services available to you.  

5. We may share your information for contests and promotions: We may offer  Promotions through the Services that may require registration. By participating in a  Promotion, you are agreeing to the official rules that govern that Promotion, which  may contain specific requirements of you, including, allowing the sponsor of the  Promotion to use your name, e-mail and/or likeness in advertising or marketing  associated with the Promotion. If you choose to enter a Promotion, you agree that  your Protected Information may be disclosed to third parties or the public in  connection with the administration of such Promotion, including, in connection with  winner selection, prize fulfilment, and as required by law or permitted by the  Promotion’s official rules, such as on a winners list.  

6. We may share your information for reasons not described in this Privacy  Policy: However, the Company will inform you before we do that.  

ADMINISTRATIVE AND LEGAL:  

The Company shall cooperate with Government and law enforcement officials and  private parties to enforce and comply with all the Applicable Laws. Thus, we may  access, use, preserve, transfer and disclose your information (including Protected  Information, IP address, Device Information or geo-location data, etc.), to government  or law enforcement officials or private parties as we reasonably determine is  necessary and appropriate to:  

  

i) satisfy any applicable Law, regulation, subpoenas, Governmental requests or  legal process;

ii) protect and/or defend the terms and conditions applicable to use of the Platform  or the Services, including investigation of potential violations thereof;  iii) protect the safety, rights, property or security of the Company, Platform or the  Services or any third party;  

iv) protect the safety of the public for any reason;  

v) detect, prevent or otherwise address fraud, security or technical issues; and /or  vi) prevent or stop activity we may consider to be, or to pose a risk of being, an  illegal, unethical, or legally actionable activity.  

ACCESSING & CORRECTING YOUR PROTECTED INFORMATION:  

The Company will take reasonable steps to accurately record the Protected  Information that you provide to us and any subsequent updates. We encourage you  to review, update, and correct the Protected Information that we maintain about you  as the accuracy of your information is important to us. We encourage you to  periodically review the information you have provided to us and update the same if  there are any changes or errors to the information.  

Your right to review, update, and correct your Protected information may be limited,  subject to the law of your jurisdiction: If your requests are abusive or unreasonably  excessive, where the rights or safety of another person or persons would be  encroached upon, or if the information or material you request relates to existing or  anticipated legal proceedings between you and us, or providing access to you would  prejudice negotiations between us or an investigation of possible unlawful activity.  Your right to review, update, and correct, as well as delete your information is subject  to our records retention policies and applicable law, including any statutory retention  requirements.  

EMAIL/SMS OPT-OUT OF YOUR ACCOUNT:  

You can opt out of receiving our marketing emails and/or SMS by unsubscribing us.  To stop receiving our promotional emails and/or SMS, you can write to us at  support@telsotech.in. It may take us about Seven (7) days to process your request.  Even if you opt out of getting marketing messages, we will still be sending you  transactional messages through email and SMS about your orders. 

DELETING INFORMATION OR ACCOUNT:  

You may request that we delete Protected information about you that is inaccurate,  incomplete, or irrelevant for legitimate purposes, or are being processed in a way  which infringes any applicable legal requirement. When you delete your account, your profile, shipping address and rent history will be permanently removed.

If you would like to permanently delete your account, please use the "Contact Us"  or email us on support@telsotech.in. If you delete your User Contributions from the  Platform, copies of your User Contributions may remain viewable in cached and  archived pages, or might have been copied or stored by other Users of our Platform.  Proper access and use of information provided on our Platform, including User  Contributions, is governed by our Terms and conditions:  

Terms and Condition

SECURITY:  

The Protected Information and Usage Information we collect is securely stored within  our databases, and we use standard, industry-wide, commercially reasonable security  practices such as encryption, firewalls and SSL (Secure Socket Layers) for protecting  your information. However, as effective as encryption technology is, no security  system is impenetrable. We cannot guarantee the security of our databases, nor can  we guarantee that information you supply won't be intercepted while being transmitted  to us over the Internet or wireless communication, and any information you transmit to  the Company you do at your own risk. We recommend that you do not disclose your  password or One time passwords to anyone.  

In addition, we take reasonable steps to ensure that we retain Protected Information  about you only for so long as is necessary for the purpose for which it was collected  and consented, or as required under any contract or by applicable law.  

GRIEVANCE OFFICER:  

The Company hereby appoints Support Manager as the grievance officer for the  purposes of the rules drafted under the Information Technology Act, 2000 and rules  made thereunder and for any other law for time being in force is applicable to the  Company whose contact details are given under this clause. You may address any  grievances you may have in respect of this Privacy Policy or usage of your Protected  Information or other data to him.
